These Terms of Service ("Terms") govern your use of FAKHERI Digital's website and services. By submitting an enquiry, engaging our services, or using our website, you agree to be bound by these Terms.
1. Acceptance of Terms
By using our website or engaging our services, you confirm that you are at least 18 years old and have the authority to enter into this agreement. If you are acting on behalf of a company, you represent that you have authority to bind that company to these Terms.
2. Services
FAKHERI Digital is a boutique AI automation studio. We design and build custom AI systems, workflows, integrations, and automation pipelines on a project basis. Each engagement is individually scoped, priced, and agreed upon before work begins. We do not currently offer software subscriptions or recurring product licences.
3. Project Agreements & Payment
- All project work is governed by a written scope document agreed by both parties before work begins
- Pricing is fixed per project scope — not hourly or subscription-based
- Payment terms (deposit, milestones, or full payment) are specified in each project agreement
- All prices are in USD unless otherwise stated in the project agreement
- Invoices are issued via the method agreed at engagement start
4. Refunds & Cancellations
Refund terms are set out in individual project agreements. In general: if a project is cancelled before work begins, any deposit may be retained to cover discovery and scoping time. If a project is cancelled mid-build, payment for work completed to the cancellation date is due. Disputes are resolved through good-faith discussion before any other process.
5. Acceptable Use
You agree not to use our services or any deliverables we produce to:
- Violate any applicable laws or regulations
- Generate spam, misleading, or fraudulent content
- Infringe on intellectual property rights of others
- Engage in abusive, harassing, or harmful activities
- Resell or sublicense our work products without written permission
6. Intellectual Property
Upon full payment, all custom-built deliverables and work products produced for your project are owned by you. FAKHERI Digital retains ownership of any pre-existing tools, frameworks, or intellectual property used in the build (which are licensed to you for use within the delivered system, not exclusively). All website content — copy, design, brand elements — remains the property of FAKHERI Digital unless explicitly transferred.
7. AI-Generated Content
Content generated by AI tools built for your project using your inputs is owned by you. You are responsible for reviewing, editing, and ensuring the accuracy and appropriateness of any AI-generated content before use. We are not liable for inaccuracies in AI outputs.
8. Confidentiality
We treat all client business information, project details, and data as confidential. We do not share your information with third parties except where required to deliver the project (e.g., third-party platform integrations you have authorised). We are willing to sign a mutual NDA prior to any engagement — contact us to request one.
9. Limitation of Liability
To the maximum extent permitted by law, FAKHERI Digital shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of our services or any delivered systems. Our total liability shall not exceed the total amount paid by you for the specific project giving rise to the claim.
10. Indemnification
You agree to indemnify and hold harmless FAKHERI Digital from any claims, damages, or expenses arising from your use of delivered systems, your own business operations, or your violation of these Terms.
11. Governing Law
These Terms are governed by applicable law. Any disputes that cannot be resolved through good-faith negotiation will be subject to the jurisdiction agreed in the individual project agreement.
12. Changes to Terms
We may update these Terms from time to time. The updated version will be posted on this page with a revised effective date. Continued use of our website or services after that date constitutes acceptance.
